Solving a $5.6 Million Problem
Result: The On Call Trial Counsel team secured a defense verdict for our client, a leading supplier of specialty chemicals.
Problem: What do you do when one of the largest suppliers and distributors of food and pet supplies in the U.S. alleges that your company is responsible for tainting nearly 20 million cans of fruit, and seeks $5.6 million in damages?
Solution: Unable to settle the case, Archer Norris’s trial team emerged victorious after a three-week trial. Plaintiff asserted four causes of action against our client. The jury found in favor of our client on all causes of action except one, finding the plaintiff to be 90% at fault. Plaintiff’s failure to mitigate damages was greater than the damage award; therefore plaintiff was entitled to nothing. Our request for attorneys’ fees was denied by the trial court. Archer Norris handled the appeal and the Appellate Court awarded attorneys’ fees.
