Mike McGuire

Special Counsel

A legal counselor to construction industry professionals through out California, Mike McGuire serves on the Construction Defect Defense Team of Archer Norris. He has been involved in large cases with more than 38 parties, which resulted in lengthy trials relying heavily on expert witness testimony.

A Trusted Veteran in Construction Litigation and Liens

Mike’s ongoing practice focus includes providing advice and litigation support to construction professionals dealing with the prosecution of and defense of mechanics lien claims, primarily for private works.

He approaches his practice with the viewpoint that it is better to identify the potential challenges in advance, which are inherent in all construction projects and deal with them at the outset. This is preferable to being forced to assume a reactive posture should something go wrong.

A Focus on Real Estate and Landlord-Tenant Issues in California

Mike has extensive experience counseling and representing, landlords in the development, use and corporate operations of their real property ventures.

He played a significant role in the formulation of the 1988 Fair Housing Amendments Act with regard to age restricted rental properties and more specifically, mobile home parks in California

Mike’s experience includes appearing before local, state and federal government administrative bodies to argue on behalf of his clients. Mike also represents these same clients in both state and federal courts, not only in matters relating to landlord/tenant issues but in matters relating to zoning, land use, rent control and discrimination claims.

 

Representative Matters
Mike played a significant role in the formulation of the 1988 Fair Housing Amendments Act with regard to age restricted rental properties and more specifically, mobilehome parks in California.

Mike has served as a registered lobbyist and given testimony before both houses of the State Legislature on health care related issues on behalf of licensed health care professionals.

Complex Construction Defect Matters
Has participated as part of the defense team of a well-known product manufacturer who was sued under a products liability theory in various courts through out the State.

Industry Representation
Mike has represented both health care and mobile home park owners for many years before both local, state and federal administrative, governmental and judicial bodies.

Employment Law
Mike has represented litigants in trial in both state and federal courts in employment matters based on Title VII, Federal Civil Rights and Fair Employment and Housing Act claims.

Published Cases
Mike has published cases in both the 9th Circuit Court of Appeals and the Eastern District Courts dealing with First Amendment rights of public employees and the concept of  "state action" in federal civil rights actions brought under 42 USC§1983.
